1inch Lawyer: Regardless of midterm election results, U.S. crypto regulation will be primarily driven by federal agencies.
According to Cointelegraph, during the US midterm election voting, 1inch Deputy General Counsel Maylea Ma stated that election outcomes could influence the trajectory of the stalled CLARITY Act, but "substantial progress" in US digital asset regulation over the coming years will primarily originate from the SEC, CFTC, and Treasury Department rather than Congress.
Ma noted that these agencies are increasingly engaging with crypto projects, but agency guidance cannot provide the legislative stability the industry expects, with the long-term objective remaining codified statutes that cannot be reversed by a change in administration. Michael Ho, co-founder of D3 at the Doma Protocol team, also remarked that the stagnation of the Market Structure Bill leaves US crypto policy reliant on agency guidance vulnerable to reversal by future administrations, prompting institutional capital to remain on the sidelines.
